The course outlines the necessary protocols and procedures mandated by the USCG as stipulated in 49 CFR Parts 4, 5, and 16, particularly for employees in the maritime and shipping sectors, where these requirements may differ from or extend the drug and alcohol testing protocols established in 49 CFR Part 40.

It is essential for DERs to comprehend and adhere to the specific regulations governing their respective transportation modes. Employers face the risk of non-compliance if they follow the Department of Transportation (DOT) protocols without also adhering to the regulations set forth by their modal agency.

DERs engaged with maritime and shipping personnel must possess a thorough understanding of the regulations outlined in 49 CFR Parts 4, 5, and 16, in conjunction with those in 49 CFR Part 40, particularly concerning Safety Sensitive positions governed by these regulations.

An individual who is aboard a vessel operating under the authority of a license, certificate of registry, or merchant mariner's document. This also includes individuals who are engaged or employed on a U.S.-owned vessel that is required to be operated by someone holding a license, certificate of registry, or merchant mariner's document.
