It outlines the specific protocols and procedures mandated by the FRA under 49 CFR Part 219 for certain railroad industry employees, which differ from or expand upon the drug and alcohol testing regulations specified in 49 CFR Part 40.
It is essential for DERs to comprehend and adhere to the unique requirements of the transportation mode governing their sector. Employers face the risk of non-compliance if they follow Department of Transportation (DOT) protocols without also adhering to those established by their modal agency.
DERs engaged with railroad personnel must possess a thorough understanding of the regulations set forth in 49 CFR Part 219, in addition to those in 49 CFR Part 40, particularly concerning safety-sensitive positions regulated by this modal agency.

Covered employee: An individual who engages in hours of service functions at a frequency sufficient to qualify for inclusion in the railroad’s random testing program. Typical personnel categories performing these functions include locomotive engineers, trainmen, conductors, switchmen, locomotive hostlers/helpers, utility employees, signalmen, operators, and train dispatchers.
