DER Training Course - FMCSA
The Designated Employer Representative (DER) Training equips DERs with essential knowledge of the drug and alcohol testing sector and the supervisory skills necessary for adhering to both federally mandated U.S. Department of Transportation (DOT) drug and alcohol testing regulations and non-regulated policies. This addendum to the FMCSA DER course enhances the self-guided training by detailing the protocols and processes established by the Federal Motor Carrier Safety Administration (FMCSA) under 49 CFR Part 382. These guidelines are particularly relevant for businesses employing Commercial Driver's License (CDL) holders or others regulated by the FMCSA, especially where they differ from or expand upon the drug and alcohol testing procedures outlined in 49 CFR Part 40.
It is essential for DERs to understand and comply with the specific FMCSA requirements. Employers risk non-compliance if they do not adhere to DOT protocols. DERs working with CDL holders and other FMCSA-regulated individuals must be aware of the guidelines specified in 49 CFR Part 382 in addition to those in 49 CFR Part 40.
Safety-Sensitive Positions Covered Under FMCSA Drug and Alcohol Testing Program:
- Any individual holding a Commercial Driver's License (CDL), or a comparable license from Mexico or Canada, who operates a Commercial Motor Vehicle (CMV) in any state.
- A CMV is defined as a vehicle:
- With a gross vehicle weight rating/gross vehicle weight or gross combination weight rating/gross combination weight of 26,001 pounds or more; or
- Designed to carry 16 or more passengers (including the driver); or
- Of any size that transports hazardous materials requiring placarding.
Students Will Receive:
- An overview of testing procedures to comprehend the complete testing process.
- Insight into the rules and regulations of each U.S. Department of Transportation mode pertaining to drug and alcohol testing, ensuring compliance regardless of whether the business is regulated by the Federal Aviation Administration or the Federal Railroad Administration.
- A comprehensive understanding of the DER's role to guarantee adherence to company and DOT policies.
